Help for 'Underwater' Homeowners

 
If you're a homeowner on the brink of foreclosure, refinancing your loan at a lower interest rate could be your last chance to keep your home. But for millions of homeowners refinancing may seem impossible because they are "underwater' - the value of their home is now less than their mortgage.

Nearly one-in-four people with home loans have this problem, according to First American Core Logic. But the federal government's Home Affordable Program may be able to help.

Underwater but still employed
The Home Affordable Refinance Program (HARP) lets qualified borrowers refinance a first home mortgage even if the size of that mortgage is as much as 125 percent of a home's value.

The program aims "to provide access to low-cost refinancing for responsible homeowners suffering from falling home prices," according to President Barack Obama. It's designed to lower the interest rate and payments on your home loan. It could also help you replace an adjustable rate mortgage with a more stable fixed rate mortgage.

However, potential borrowers must show that they are employed and will be able to make their payments. There's no minimum credit score to participate though a low score could effect your interest rate. Applicants are immediately disqualified if they have been more than 30 days late on any home loan payments in the past 12 months.

The structure of the current loan also makes a big difference. For example, the loan has to be owned or guaranteed by Fannie Mae or Freddie Mac to benefit from this program. Don't panic - there's a good chance that your banker sold your loan to one of these two mortgage giants after they made the loan to you. Find out here for Fannie Mae or here for Freddie Mac.

Contact your lender or loan servicer to apply for the program - you should find the phone number on your monthly mortgage statement. You should have the numbers on your current income and expenses ready before you call. Here's a list of the documents you'll need.

You may also be able to work with a new mortgage company to refinance a Fannie Mae loan, provided the new lender is capable of making a Fannie Mae Desk Underwriter Refi Plus loan.

Difficulty making your payments
If your loan is bigger than the value of your house and you've already missed or made late payments on that mortgage, you may still qualify for the federal Home Affordable Modification Program (HAMP) available through mortgage lenders.

It's not a refinance program - instead the original mortgage is left in place while the terms of that loans are changed to lower the contract terms.

Once again, you will work with your mortgage company. Your monthly payments may be lowered to a rate you can now afford for as long as five years. Starting in year six, the interest rate on the loan, and the amount of your payments, may begin to increase by up to one percent until the rate reaches "the market rate at the time the modification agreement is prepared," according to the program Web site.

Your lender may also lower your payments by spreading them over a longer period, for example extending a 30-year loan term to 40 years. It could even forgive part of your debt.

Applicants will have to demonstrate financial hardship that puts your mortgage in imminent danger of default - your current monthly mortgage payment must be more than 31 percent of your current gross income and you must demonstrate that you are having difficulty making the payments. Also, you can't live in a mansion - the mortgage must be for an amount less than $729,750. Also, just like HARP, your loan must be owned by Fannie Mae or Freddie Mac.

Call your lender or loan servicer to find out of it is participating in the program - most are. You can find the number to call on your monthly mortgage statement.

Other options
If you don't qualify for either of the governments Home Affordable programs, you may still be able to negotiate a loan modification with your lender. Remember, if the lender seizes your house in a foreclosure, it is unlikely to be able to sell the house for the full value of the home mortgage in an auction.

Ask about the possibility of a short sale, in which you would sell your house at market value even though the price is likely to be less than the amount of the mortgage. In a short sale, the left over loan balance is forgiven. The mortgage company loses money on the deal, but usually not as much money as it would lose in a typical foreclosure and both you and the mortgage company are spared the expense and damage of the foreclosure process.

HERE WE GO WITH A SHORT SALE
The first time I heard a buyer say they thought a short sale was someone who needed to sell quickly (in other words, they thought the sale would happen in a short period of time), I giggled a little. When I thought about it, I could totally understand the thought pattern. The reality is nearly the opposite....a short sale can be anything but short!

The term actually refers to the current owners needing to sell and being "short" the funds it will take to pay off the lender. So, the current owners need to negotiate with their lender an alternate repayment plan or forgiveness of the remaining debt. In today's market, banks are doing anything to avoid foreclosures, so we are seeing more and more short sales approved; very often with full debt forgiveness to the sellers.

This is truly a win for the sellers. Sure, their credit takes a hit. But, their bank accounts and immediate financial future is far better off than if they were to go through a foreclosure. And, it is expected that many of these sellers will be eligible for purchasing again in the not so distant future.

Buyers, on the other hand, need to be willing

 According to a recent National Association of Realtors survey, your Realtor® is statistically likely to be a 54 year old college educated woman who owns her own home, has no other job, is likely be the only wage earner in the house, has no benefits through her firm, and is coping with decreased wages and the need to cut expenses.  Her income is likely to be around $37,000 though might be about $54,000 if she has had 16 or more years experience.  About 27% said it was uncertain if they would remain in the field at least two more years.

This portrait that emerges from the myriad statistics gathered by the NAR is that of a hard working professional very much in tune with issues faces by clients in difficult financial times.  The stats challenge the myth that Realtors® are rolling in money from their 6% commissions.

  • 60% of all Realtors® are female.
  • The median age of Realtors® is 54 years old.
  • 75% of Realtors® don't have a second job whereas 25% state real estate is not their only occupation.
  • Under 50% of Realtors® surveyed noted real estate is their primary source of household income.
  • 72% of Realtors® receive no benefits through their firm.
  • Median gross income of Realtors® fell 14% to $36,700 in 2008.
  • Median gross income of Realtors® with 2 years or less experience was $8,600.
  • Median gross income of Realtors® with 16 years or more experience was $53,900.
  • Realtor® annual business expenses fell to $5,810 in 2008 from $6,580 in 2007.
  • 73% of Realtors ®reported being "very certain" they'll remain in the business for at least two more years (so 27% reported uncertainty of being in business for that long).

The deal with statistics is that not everyone is at the median so some Realtors® are prospering despite the recession.  There is still opportunity out there!

This is rebloged from an expert in the mortgage industry.

This is the best explanation of this market yet............please read it and these newer laws with appraisals are taking us back 20 years waiting for the apprisal to reach the bank before we can close.......When the market crashed in 1989 that was minor next to this. It took 10 years for the home to gain value and I put the biggest problems between 2001-2007, we all know now subprime, but what about all the gov.......financial regulators and financial people they had to know. We have to follow this through for our children and our grandchildren so they know not to make the same mistakes??

He didn't  like delivering this bad news, and knows I don't like receiving it. He goes on to say:

"At the same time I want to tell you what I see: There are some serious (additional) problems right now, directly affecting real estate. It looks to me like it's going to get a lot worse worse before it gets better. Yet, when doors close, others open - there are resulting opportunities as well (See below). Here are some of the reasons/symptoms:
-
1.5 million homes in foreclosure

  - Appraisal chaos due to new ordering rules and short sales
- High, and still increasing unemployment. Mortgage aid for unemployed

- Collapsing commercial market. Commercial paper falls most ever

- Slow implementation by lenders of loan modification iniatives. Articles
- Lack of ability or willingness to lend. What to do with the Fed
- The Case-Shiller index continues to point towards further declining markets.

What this means in practical terms

- Appraised values as much as 30-40%(!) low, especially for refi's

- Restrictive lending environment, and tightening up more

- Construction loans virtually unavailable (unless hard money)

- Hard money lenders are raising lending criteria and pricing

- Conventional financing maximum is 90%ltv

- PMI requires 680 Fico

- Higher lending standards and erratic pricing for commercial loans

Good news, opportunities

- Investments with good cash on cash returns available

- Affordable price levels - especially for first time home buyers

- First Time Homebuyer tax credit (must close by Nov 30th!)

- Rehab homes (foreclosures) can be bought with 203(k) loans
- FHA loans, including FHA rehab loans (203k), readily available
Fannie Mae REO opps with Prospect Mortgage Homepath (rehab) loans
- Higher Fico's get lower rates
- Rates are not likely to increase (I think)

THIS IS MY COME BACK TO REALTY BLOG

I have not been ignoring what is going on in this economy...........I have been a Realtor for 20 years and had an opportunity given to me to help and also get paid, running a special program for the children K-5 for th Y it is called Aftercare................now they are the ones that really need the assurance that everything is OK for them.

I work in Freehold Township Schools, a high 6 figure income area with top rated schools.........but they will be cutting all kinds of programs also...................lots of Wall Street jobs were lost and they live in our areas....................We are still going down in price but there are wonderful buys out there............We have the highest property taxes in the nation in New Jersey. Yes we are very close to NYC for employment and entertainment....................and yes years ago we were under the impression our highways would be free someday fully paid for and that Atlantic City was going to be our big savior...........well not so....................we kept growing and building bigger and more expensive houses................we have the Jersey Shore...............went from bungalows to million dollar homes....................go figure.....I wish we could stop right now saying I want to see what this President can do...............and lets give him some confidence get your Representatives names emails and also your Senators and start emailing them how you feel and what you see out here and maybe they will listen or at least acknowledge you.I have been doing this for 2 years and get first hand answers from our Senators' I didn't vote for Pres. Obama but I am behind him all the way, please help all of us Pesident Obama and Vice President Biden.................again we did not get a bailout and we cannot collect unemployment, independent contractors' who have really been virtually out of work for over a year................

Government Websites Government loan programs offer great opportunities for many consumers in many regions across the country, especially first-time buyers and veterans. The following websites are likely one of the first of many sites potential homebuyers visit during this process:

1) HUD.Gov is the official website for the U.S. Department of Housing and Urban Development (H.U.D.) This site lists HUD homes and provides information for home buyers, including financing options and home buying programs available through the Federal Housing Administration (FHA).
2) Homeloans.va.gov: This site houses information about government home loan programs specifically for veterans.

 As I come across more interesting sites they will help I will send them on and continue to help my communities take care of their children so they can rest easy at their jobs.............but always a Realtor................................never going to retire............bye for now
